Vertical Management: Administrative Reform Of The Law Enforcement Agencies Study

Administrative law enforcement departments belong to the executive branch of the government, which is entrusted by the government and the people the sacred duty to rectify the bad social behavior, and regulate market order. Since the early 80s of 20th century, along with the construction and improvement of China's socialist market economic system, the deepening of opening up and reform of administrative system, the interrelation between central and local governments, as well as government to government relationship became a problem need to be paid much attention. From the recent reforms of administrative system, we can see that the Government is always trying to adjust this relationship to fit national conditions, and to adapt to the current national economic, political, and cultural development. Among them, the reform of vertical management system in several government agencies further reflects the new situation and the need for vertical management. After several years of implement and practice, the effects of these integrated government agencies verify the validity of the decision-making of the country, which shows that the vertical management system in our country is still worthwhile for further promotion and implementation.Over the last decade, besides the progressive implementation of vertical management from central government in some administration system including bank, tax, customs, maritime affairs and grain reservation, the intra-department vertical management has also begun to implement in provincial (city) level, such as public security, government rent, industrial and commercial administration, standards and metrology, technical supervision, and drug supervision. The vertical management below the provincial system was gradually formed. All these government departments involved in the functions of law enforcement administration. This shows a trend of using a vertical management system in administrative law enforcement departments. It is also the outcome from the adaptation to adjust the relationship between central and local development, the adaptation to reach the need of the reform of market economic system and the needs to effectively protect and promote the healthy development of the market economy. It is a choice to adapt to the international changing situation and meet the new challenges of the world.Health inspection law Execution belongs to the law enforcement administration. In January 2000, the "The views of health supervision system" was issued by the Ministry of Health, indicates that health inspection system in our country was fully implemented. In 2002, Health Inspection Center of the Ministry of Health was formally established, and the health inspection sections were gradually separated from the former epidemic prevention agencies in provincial, municipal, and county levels. Health inspection institutes were established, which was instructed by health administrative department at the same level. Health inspection institutes assume full responsibility for supervision and law execution in public health and medical health. Among them, only some provinces and cities, the pattern of vertical management in city with several districts, as well as the pattern of setting local offices in towns (subdistricts) in county-level institutes were explored. After several years implementation, a lot of problems were emerged in both health inspection system construction and administrative management system. To address the existing problems, refer to the experience of above government agencies, we suggest the health inspection law enforcement institutes conduct the integral vertical management pattern, to enforce the capability construction in grassroots health inspection agencies and teams, to integrate limited resources, and to improve the efficiency and effectiveness of law enforcement administration, which allow the health supervision and law enforcement play its active role in the maintenance of socio-economic order and promoting social harmony.Based on theories in public administration administrative reform, the government management system, this article use literature research, data analysis and empirical research methods, use health supervision and law enforcement as an example, and successful experiences in both vertical management in domestic government and foreign government management system on the relationship between central and local governments as a reference, to analyze the pros and cons of the implementation of a vertical management system in administrative law enforcement department, and to provide recommendations to the implementation of vertical management. We hope that the health inspection agencies below the provincial level could implement integrated vertical management, to insure their function today's situation while public health services has drawn greater attention.
