Trade union is established to safeguard the legitimate rights and interests of employees, and safeguarding rights is considered as legal duty for it. However, for a long time, because of inclination of macroeconomic policies and imperfection of construction of legal system and market economy system, the safeguarding function of trade union is restricted badly, which, together with the imbalance of labor relations, lead to infringement of legitimate rights of employees. Against this background, the safeguarding problem of trade union of Hengyang Road Enterprises comes up. As representative for masses and interests of employees, the enterprise trade union always gets into trouble, when fulfilling the duty of safeguarding rights. On the one hand, Trade union can not safeguard the legitimate rights and interests of employees effectively; on the second hand, the legitimate right and interests of its own is also not maintained. Therefore, how to safeguard the legitimate rights and interests of employees and trade union at greater degree so as to relieve conflict of labor relation becomes the main problem to resolve for Hengyang Road Enterprises. As a worker of Trade union organization of Hengyang Road Enterprises, the author should undertake the duty unaffectedly.This thesis , on the research approach, unifies principle insisting and the logic method historically, and uses theory study combined with positive research, static behavior analysis and dynamic analysis to combine, innovating and inheriting such methods as relevant licenses, etc. Finally it achieves comparatively deep study to the regulation countermeasure of safeguarding rights of our country of new period. It elaborates safeguarding function of trade union theoretically, at the same time, integration development status of safeguarding of Hengyang Road Enterprise, it finally poses the optimized way to safeguard rights for labor union of Hengyang Roads Enterprise.This thesis contains five parts. The first part advances the research background of this subject. Based on amount of literature, the second part carries out a synthesis of relevant literature, laying a theoretical basis for latter research. By analyzing Safeguarding status of labor union of Hengyang Roads Enterprise, the third part proposes the problem of this research. The fourth part investigates underlying causes of problem that labor union safeguard rights and interests of employees, pushing the way for solving the problem in next part. The last part poses optimized ways that how to improve the function of safeguarding of labor union, fulfilling the Research objectives of this subject.
