Analysis Of The Path To Achieve Judicial Justice

With the development of the socialist market economy and the aim of founding a socialist state ruled by law has been fixed,the functions and status of judicial is becoming much more important.Judicature has been the normal way to solve conflict by people.In modern times, the realization of judicial justice is always the dream to human being.According to China's national condition,judicial equality plays a very important roll in putting forward the development of all respective cause of socialism and the harmonious society and stability of the entire society.However,the state of judicature in China is far from people's satisfaction.The main factors that prevent from achieving the judicial modernization goal is still the inequality justice.With the further judicial reform taking place,the discussion on the directional issues about judicial reform between the theoretical and practical circles becomes pretty heated.This article falls into four parts. Part One has elaborated on the theoretical connotation and practical significance of judicial justice. Following that comes the expounding about the present situation in view of the arbitrariness, inefficiency, corruption existed in our nation's judicial system and the theoretical analysis of the causes of current problems. The third part combs and analyzes the current discussion of educational circle about the crucial factors hindering judicial justice realization, suggests that the current barriers to judicial justice consist in judges's low professionalism, unreasonable system design of judicial supervision as well as the lack of substantive guarantee of judicial activities, and puts forward the way to integrate the judicial professionalization with supervision system perfection. Finally, on the basis of referring to the existing occidental experiences and combining with our country's actual conditions, the last part mainly proposed that to realize judicial justice in China, we should intensify the construction of judge professionalization under the existing judicial system, refine the judge selection and punishment system, consummate the judicial supervision system,construct the reasonable supervision system and independently funded judicial system.
