Research On The Realization Of Judicial Justice

Judicial justice has always been the value of judicial work, especially during the period of building a country under "the socialist rule of law ". Judicial justice has become a popular topic among the people. In the 4th plenary session of 18th CPC Central Committee, judicial justice was emphasized again. " Justice is the lifeline of the rule of law ". "Judicial justice plays an important leading role in social justice ".But we still have many problems during the operation of jurisdiction. For example, judicial corruption, the low level of judicial efficiency, the phenomenon of people’s dissatisfaction always happen. So researching the way of judicial justice is important to the judicial reform, the prevention of corruption, the non-corrupt judicial team, the guarantee of human rights, the maintenance of the rule of law authority and the judicial efficiency. It also plays an important role in building a country under "the socialist rule of law".In this paper, by using the literature analysis and the empirical analysis, summarizes the achievement of the way of judicial justice. We reached" the case quality evaluation system" of many provinces, mainly in Shanxi Province. Under the background of building a country under "the socialist rule of law", based on the judicial reform and mechanism innovation, as the target orientation of "the case quality evaluation system", as the basic way of judicial publicity, the trial management information and the improvement of the judiciary’s character promote the realization of judicial justice. This article is divided into four main parts:The first part forms the concept of judicial justice and the way of judicial justice from different angles. This part analyzes these two concepts carefully.The second part analyzes the data collection of " the case quality evaluation system" of many provinces, mainly in Shanxi Province and made a summary of it. Then analyze the rationality and effectiveness of the way of judicial justice from the theory and practice. It has laid a solid empirical base of the next paper.The third part analyzes the problem of the realization of judicial justice according to the survey data from the point of view of legal theory. Then analyze the bad factors affecting the realization of judicial justice.The fourth part summarizes the measures and practice of innovative ways of the realization of judicial justice in our country in many years. And combined with the results of the survey data put forward the concrete way and method of realizing judicial justice. It is significance to the realization of judicial justice in the future.In short, this paper obtains from the concept to redefine and empirical study. Through the analysis of survey data and the research of the realization of judicial justice, we try our best to find the most suitable way to realize judicial justice in our country. It is very helpful to build a country under "the socialist rule of law" and deepen the judicial reform.
