Basic Legal System Of Foreign Urban And Rural Planning A Comparative Study

Implementation of the Urban and Rural Planning Law in 2008 marked the urban and rural planning to establish the basic legal system. Basic legal system of Urban and Rural Planning Law has been run through urban and rural planning. We research and improve it to benefit our country that is rapidly growing urban and rural construction. This paper uses literature, comparative analysis and empirical research method, etc., anglicizing the Western developed countries of the basic system of urban and rural planning law in order to summarize its merits and then compared to China and Western countries the urban and rural the basic law system of planning put forward their own ideas in order to make a point on the value of urban and rural planning study. This paper is divided into four parts:Urban and rural basic legal system is not have a clear definition in the academic, in the first part author mainly defined it and advanced the extension and intension of the basic law of urban and rural planning system, further proposed urban and rural planning should include three major basic legal systems: public participation system, monitoring system and relief system, then explained the internal relations in the three basic legal systems.The author considered the main involvement of the public system in second part, further elaborated participation system on the public. The paper in this part researched public participation system of many countries such as American, UK, Germany to analysis of public participation system has the features and advantages with our country system in the comparison of its short comings, and then put forward proposals to expand the scope of participation in phase.The third part focuses monitoring system in urban and rural planning. Research the United States, Britain and France in town and country planning in the monitoring system to study and summarize its advantages, compared with our country in order to propose defects and deficiencies, making reference to other countries how to improve the merits of proposed further development and improvement of the system of urban and rural planning inspector recommendations and ideas.The fourth part expounds relief system in urban and rural planning, research the United States, Britain and Germany on relief systems for Planning, explained the importance of judicial relief obtained. Discussing our planning legislation of the relief system and characteristics, proposed to strengthen the urban and rural planning of judicial relief in order to improve the administrative review system and other measures.Conclusion: The author emphasized the importance of urban and rural planning again, improved the urban and rural planning basic legal system is necessary, but should be gradual.
