On The Path Of The Judicial Professional Ethics Construction Of Socialism

Judicial ethics is that all judicial career in the judicial activities shall comply with the basic moral principles, is an important part of social morality, but also to protect the smooth progress of the judicial activities of the moral constraint rules. But in our current society, the objective conditions, the judicial career has shown many problems, and even affect the image of the set of judicial authority. Therefore, it is very important to the study judicial ethics construction,which can improve the current judicial ethics and judicial activities have significant implications for the smooth.Particularly,in the current under the guidance of the socialist core value system,professional ethics of justice will along the direction of socialism for requesting a more scientific professional ethical.This paper is divided into four parts discussed. First of all, from the meaning and fearures of the professional ethics and socialist judicial ethics, analysis China's judicial ethics, including laws and regulations, criterion, social ethics, etc., the main source; and make our country the importance of professional ethics of justice, mainly because of its socialist judicial career development needs, to achieve fairness and justice and an important guarantee for building a harmonious socialist society the necessary links. Second, analysis of the contemporary Chinese legal status of professional ethics, problems and the main causes. There are great achievement of Construction of Judicial Ethics has made in recent years, both appropriate laws and regulations are formulated,and there are more and more the judicial model of emergence,such as Judge Song Yushui. But more serious problem are still,for example the laws and regulations in the exercise of professional ethics itself,which are the most binding,because of the abstract and a general,it lack of maneuverability. And judicial professionals lower their moral standards, judicial injudics and judicial corruption is serious. The reasons are both objective and subjective reasons,but also the diversification of justice of civilization, social thought and social values caused reasons of value. It requires that building of judicial ethics requires high level and unity guide values. Therefore, in the third part of this thesis I put forward the socialist core value system to guide China's socialist construction of judicial ethics. There are four main parts of ocialist core value system,covering the guiding ideology of Marxism, the common ideal of socialism with Chinese characteristics, National spirit with patriotism as the core and the spirit of innovation as the core spirit of the times and socialist concept of honor. Use it to guide the need for another judicial ethics both feasibility. Among them, the socialist core value system in society establish the guiding position, basic characteristics, as well as judicial ethics problems of the targeted building for judicial professional ethics should be guided by the core value system. The basis of both the material and socialist property and the same purpose, to create the possibility of such guidance.Because the fuction, of the core value system, which containing guidance,integration, cohesion and inspiration adapt the issue of the judicial ethics problems that exist in the building, it is the role of guidelines with a feasibility. Finally, it can establish the basic path of judicial professional under the guidance of ethics in the core value system, including the clear value of the socialist core value system guiding position,to enhance their own system, security system, the construction of moral evaluation and supervision system, and to improve the judicial career that the moral and professional qualities,and then use the basic idea of the core value system guiding judicial professionals to improve the moral spiritual realm. The values, institutions and individuals at different levels to promote the building of socialist ethics of justice,is the requestion of building the socialist core value system.It is also a only route of professional ethics construction.
