Study Of Ipr Customs Protection Legislation

Customs protection of Intellectual Property(IP) rights is kind of a new territory of adminstrative law enforcement in our country. Our country began to pretect IP rights at the field of import and export after the regulation of "Intellectual Property Rights Customs Protection of the People's Republic of China" in July 5th,1995. And we enforced the job of Customs protection of IP rights and built up a general system of regulations after we joined WTO and began to implement "Agreement on Trade-Related Aspects of Intellectual Property Rights". While international discords caused because of our exports violates IP rights of the right holders and lead to their loses on rights and interest, especially economic interest. On the other hand, during the period of more than 10 years practice, we've achieved a lot while we have yet a lot to do. For example, some certain regulations are lack of certainty and practicality, some certain regulations are hard to achieve, some illegal export goods seized by Customs of other country will cause new internatiol trade discords etc. So, after a lot of work on the study of the Customs protection of IP rights of our coountry, the author proposed some suggestions to implement the job of Customs protection of IP rights.
