As the rapid growth of the international trade, issues on intellectual property rights have become more and more important. Meanwhile, the illegal international trade, which violates the intellectual property rights, is growing fast as well. The huge volumes of the illegal cases bring enormous damage to the international trade. The international society comes to the common point that the customs protection is becoming one of the effective methods to protect the intellectual property rights across countries more and more.It's Chinese international obligation to execute customs protection of intellectual property rights under the condition of joining WTO, which is the effective approach to protect the rights and interests of people as well as developing our country's competitive ability in the international market. In addition, it is the inner urge for China customs to build modern customs system, deepen innovation and transfer the functions.This article consists of three parts. The first part is the general introduction to legal system of customs protection of the intellectual property rights, it analyses the characteristics of customs protection of intellectual property rights, and its history. In addition, this part introduces the international customs protection system of intellectual property rights according to TRIPS Agreement. The second part gives a detailed introduction to Chinese current customs protection systems of intellectual property rights .The last part is the most important one of this article. With the comparing and positive methods, after pointing out the existing problems in our customs protection system, this part provides several settling approaches accordingly.
