College Student Privacy And Student Management, Conflict And Adaptation

It is a progress in society that people pay attention to the conflict between students' right and the administration of college in recent years. Colleges have the administrate right according to the law, administrative right is a positive right and privacy right is a negative right, so we should pay more attention to the privacy right of students in colleges and assert this right appropriately when there are conflicts between the two rights. The existence of students' privacy right means the existence of the idea and the institution which other people undertaking obligation. Colleges should management according the law to protecting the right to privacy of students.This paper includes five parts, the main contents as following:1. Introduction. This part describes the background and the significance of this paper, and gives a simple review of current research situation of the issue.2. The right to privacy which in the category of students' rights. Students of colleges have two statuses. Firstly they have all legal right as ordinary citizens. Secondly they have specific rights, which their status and tasks needs. As they enjoy some rights that other people do not have so must undertake some obligations which ordinary citizens do not have and their ordinary rights will be restrict in some situation for the status of student. Colleges students are legally entitled to right to privacy, this part define the concept of students' right to privacy and state the connotation, the extension and the restrictions of this right.3. The conflict between students' right to privacy and administration of colleges. Students' right to privacy includes three aspects: private information, private affair and private space. This part enumerates the conflicts between these three aspects and administration in colleges. The conflicts between private information and administration mainly manifested in the lower administrate and the administrators' deficient awareness in law; the later two kinds of conflicts partly manifested in the indistinct limit of students' right to privacy and administration in colleges, and partly manifested in the behavior which administrators beyond their duty.4. Analysis of the reasons that restrict students in colleges regularly exercises their right to privacy. Our country lack the social traditions, which respect and protect the right of individual.The social values, ignore the rights of colleges students, the relationship between students and higher institute is ambiguous and students are placed in disadvantage position in this society.All of these four factors influence the regular exercise of students' right to privacy.5. The mediation between students' right to privacy and colleges' administration. The mediation between students' privacy right and the colleges' administration depends on many aspects: firstly we should have the idea that students is the basic, secondly the law must include the content of legal right that student have and the administrative limitation of colleges, thirdly the process of administration should according to the law and reflect the spirit of scientific management. Only by doing these the students' right to privacy in colleges would fully be realized.6. Conclusion.
