Sports Ethics And Legal Construction Of The Traditional Model And Its Modern Structure

The research objects of this thesis are sports moralities and legal system patterns. By using means of literature data analysis, comparative analysis and logical induction, combined with the analysis of different patterns, conclusion of historic limitations in ancient days and values in the contemporary era, we have summarized sports moralities and legal system patterns with space-time sense in different historic periods. On the basis of analysis and conclusion we also constructed the contemporary sports moralities and legal patterns. The innovation of this thesis is not only summarizing sports moralities and legal patterns in different historic and cultural backgrounds but also composing modern sports moralities and legal patterns. We have given some advice on how to construct Chinese characteristic modern sports moralities and legal patterns, which are based on multi-culture's background, with dialectic viewpoint on our traditional culture and following our cultural track. Following historic track, this research gives the definition of sports moralities and legal patterns, summarizes the limitation of sports moralities and legal patterns in various historic eras, seeks the reference values to our Chinese sports in the contemporary era as well as the effect which the cultural groundwork gives to our consciousness. This can supply an effective inherited and innovative precondition to constructing up-to-date sports moralities and legal patterns. The in-depth study from the point of view of morality and legal system has profound realistic significance, which could solve the problems of contemporary sports as well as constructing harmonious society.This paper mainly consists of the following parts.1. From the point of view of using morality and law to normalize the development of society, we must solve the social question recurring to impelling law, because our country is different from other country with western culture. We should melt the reasonable factors of western value viewpoint into our eastward culture and finish the transform from traditional culture value viewpoint to modern's.2. Sports moralities and legal patterns, which refer to a certain society and class from their own society developing needs, constructing their own all-around academic model and practice pattern which built on sports moralities, legal construction aim, content, means, instrument and approach.3. On the effect of traditional Confucian culture, archaic sports moralities and legal patterns have come into being the pattern of "applying law in virtue body". This pattern was in favor of stabilization of all social class but blocked the development of Chinese archaic sports and impelled sports to develop toward the way of tardiness.4. The pattern of "separate management of morality and law" in Chinese modern time, which is refer to sports moralities and legal patterns, have been effected by two sides , one side is western democratic legal system ideology attaching importance to establish system and rule, which is impulse the development of gymnastic system. The other side is rethinking of traditional cultural soul, paying attention to spirit cultivation and accelerating the development of national traditional sports.5. "Politics and law pattern" of Chinese sports moralities and legal system established since the foundation of New China to reformation and opening, takes "serving for people" as the core to sports work, attachs importance to the improvement of sports level, strengthens the function of thought education.6. The construction of "harmonious" pattern of our modern sports moralities and legal system is base on the academic angle of view, which includes history status, value function, pattern content and main body of implement.7. The "harmonious" pattern of sports moralities and legal system bring forward different requirements of hierarchy to the constructing of pattern. It includes three different hierarchical targets, the world relation, resource configuration and society structure.8. The "harmonious" pattern of sports moralities and legal system can primely solve the conflict between emotion and law and pursue the character of middle of the road. The operating aim of this mode is provided with the characters of arrangement and era.9. Thereinto, the sports legal system embodys the sports moralities which our community required with ordering, moreover, the sports moralities include the principles of the sports legal system which redound to improving the quality of our life and promoting the relationship of people.
