With social development and cultural progress, the legitimate status and function of education punishment are questioned. When a large scale of condemning and campaign are brought out through out the society facing to various unreasonable and illegitimate education punishment phenomena, the educational significance of punishment are completely denied. Based on literature review through points of psychology, law and philosophy on education punishment, this article attempts to establish the positive function of education punishment by describing the necessity of punishment to education, to discuss the reason of education punishment existence proceeding with analysis of problems caused by lack and lag of education law in the field of punishment as well as the unreasonable punishment phenomena in school education, and to draw out possible recommendations to figure out how to employ punishment reasonably and legitimately in school education in aspects of society, parents, school and teachers, so as to farthest restrain the defects of this dangerous measure and to bring its positive function in to full play.
