The sport association in China have established by the government,as well as supervised and controlled by the government.Its funds are provided by the government.While the law issue appeared,the sport association cannot participate in the legal proceedings and held the responsibility independently.To some extent,the sport association is just the government administrative department,it have the function and power of government.Thus,I think that is the reason why in many circumstances,the sport legal issue is resolved through the administrative way instead of legal way.Therefore,I believe that,the sport association in China should be endowed the complete seniority of judicial person.The sport association should extricate itself from the protection and control of the government.I maintain that,the key factor of the sport association is how to have more power to determine their own business. Only in this way,the sport association could have the independent seniority of judicial person in order to bear the legal responsibility.With the influence of history and culture in China,the government has still stood in a dominant position.However,the influence and restrict from the government should be set a limit to law drafting or the supervision to the sport association.In the process of sport industry,the role of the government could only be a law-maker or a supervisor.The real participator must be the sport association.Only when the sport association violated the law or the policy,the government has the power or responsibility to intervene it.In addition,in our country,the sport law is very deficiency,the government must consummate the sport law-drafting as soon as possible.The sport association should have the power of inner regulations drafting,punishment and dispute resolution. While the sport association exercised the powers above,the government should esteem the autonomy of sport association.The conflict between the government and the sport association must be settled by the court of justice.The main study methods of the thesis including:document reading,comparison, deduction and conclusion.
