Scientific Orientation Of Local Government Function In House Demolition

With rapid development of rural and urban overall plan and with the acceleration of urbanization, the implementation of city construction projects, such as old city reconstruction, new city development, promotion of urban image and quality, has brought lots of housing demolition and land acquisition. Recently, conflicts created by uneven distribution of benefits during the urban house removal are rising year by year. Cases of filed petitions have caught extensive attention of the society, which intensify social conflicts and affect the harmonious development of society. Therefore, the study to scientific function positioning during housing removal by local government contributes to the people’s fundamental interests guarantee whose houses are relocated, maintaining social harmony and stability, improving image and public trust in government, providing advice of deep study to urban housing demolition process for academia at the same time.Taking four historical stages of urban housing demolition system change as key, this article analyzes evolution process of local government functions regulation, that is, transforming from those holding multiple identities who undertake the whole things, into the housing removal manager with single identity and people oriented server. It sumps up concrete performance of poor functions regulation in aspects of social public interests abuse, multiple identity, abusing powers, making illegal benefit by using their power, and violent demolitions phenomenon.Further analyzing the root cause of this kind of phenomenon, that because of public roles arrogation of local department, in-completion of legal system for the urban house demolition and power supervision system, low comprehensive quality of some officialsand so on. It concludes reasonable advice to scientific functions regulation in the process of local housing removal by comparison, analysis and argument of Hunan and Yangzhou cases between the organicwhole.This paper holds that, once involving interests of three parties, which are local government, developer, and householder, the local government should make right location in their relationship with developer and householder, making overall plans on each party’s interest.Also, finding the balance in householder’s interest protection, fast development of city’s construction, and social public interest maintenance.So, local government should regulate roles scientifically, protecting householder’s interest, and to be scientific policymaker of housing removal compensation.Establishing identification organization, and to be scientific definer of social public interest.Enhancing full supervision, and to be executive making housing removal process open, transparent, fair and strict.Enhancing power supervision, and to be supervisor using power correctly, so that the demolition course to be onto the sunny, harmonious and stable track.
