Discussion On The Legal Guarantee Of Harmonious Development Between Natural Reserve And Local Communities

The establishment of nature reserves is the choice of humans andnature live in harmony. As a special area for ecosystem protection andconservation of biological diversity, which construction and managementlevel has become one of the standard for measuring a country's level ofcivilization and environment health, at the same time using legal means tostrengthen the management of nature reserves is being an important symbolof national civilization and progress. Since China's first nature reserve wasestablished in1956, China's nature reserves has developed rapidly, andmade remarkable achievement. However, due to the long-closedmanagement mode,there are many problems in the construction progressof Nature reserves, one of the most serious problems is that we are not ableto coordinate the relationship between the nature reserves management andlocal community's development, ignored the interests and needs of localresidents and lead to contradictions, which has not only seriously hamperedthe sustainable development of nature reserves, but not conducive to theharmonious coexistence of man and nature.Biodiversity conservation is a great cause for long-term interests ofthe whole human society, in order to maintain the biological integrity andcontinuity; it is beyond reproach to demarcate a certain areas of specialprotection to reduce the human intervention. However, the localcommunities' development is one part of the overall sustainabledevelopment strategy; people there also have the legitimate rights ofdevelopment, and their development quality will directly affect the soundeffects of the biodiversity conservation cause. Thus, we should see thecontradiction between nature reserve protection and local communitydevelopment from a dialectical perspective, and reconsider their differences, then deal with the relationship between the overall eco-efficiency and thelocal residents' specific interests.This paper studys the problems of China's nature reserve managementand protection and community development from a legal point of view,analyzes the reasons of the two sides' contradictions, and demonstrates thenecessities of promoting the harmonious development of nature reservesand local communities from different angles, finds out the inadequacies byreviewing the nature reserves legislation and studying the legislation on thelegislation on the coordinated development between nature reservemanagement and local communities. As a part of the world biodiversityconservation cause, we may also learn advanced theories and practicesfrom overseas, summer up the specific practices that are suitable for us, andproposes legal advices to promote the harmonious development betweennature reserves and the local community.
