Recently, with the development of economic in China, all social undertakings have changed day by day. Along with the social transformation , all kinds of crimes become more and more, the method of crime become intelligent, complicated and ferocity .The problem of victims will protrude gradually, some malign crimes brought different degree of damage to the victims and the victim's family, social security, and the public . in view of the actual situation, the modern criminal justice should not only to protect the human rights, should also offenders full consideration and guarantee the legal rights of the victim, if the damage of victims cannot come true , the national compensation system for criminal victims appear more important .But , The establishment of a system is required for that has legitimacy for the premise, it means that whether the presence of this system that has a reasonable basis, has the advanced theories, has the real needs , and has the normative form .
