Food safety is a historic topic. In recent years, our earth has happened Dioxin, Mad Cow Disease, Sudan Red and others significant food safety events, these cases infringed upon the rights and interests of consumers, and each time the outbreak of food safety events would cause governments and consumers concern, what's more, San Lu Milk Powder event made people put more attention on food safety in an unprecedented height, and spawned the Food Safety Law come on stage. Nowadays, Food safety has became one of the rigorous ordeals in today's life. Originally we hope that with Food Safety Law as an opportunity to perfect our country's food safety supervision system, and more effectively prevent the occurrence of food safety incidents. However, in 2010 Hogwash Oil investigation report, Melamine overweight Milk Powder's comeback, Shuanghui Lean Meat Powder and Tainted Steamed Buns were exposed in recently, which makes our expecting of food safety only to be the proceeding expectancy.Food safety needs a healthy and effective supervision mechanism, how to solve the problem of food safety regulation from institutional level, guarantee food security, thus safeguarding consumers'health, safety, which is the purpose of this paper where the topic.First of all, the author expounded the general theory of food safety legal supervision. Food safety has special meaning, which is neither different from food hygiene, nor from food qulity. The importance and critical influence of food safety determine the significant and imperative of food safety legal supervision. On top of it, the author expounded the theoretical basis and practical basis of the need for legal supervision on food safety from the politics, economics and law point of view. And then, the author analysed legal system of U.S, EU, Canada and Japan,whome are of leading in food safety legal supervision, both in the legal system and the supervision system are worthy of our terms of reference. WTO has also agreements on food safety, such as Agreement On Technical Barriers to Trade and Agreement on the Application of Sanitary and Phytosanitary Measures. Finally, it is analysis and improvement of food safety legal supervision in our country. The enaction and implementation of Food Safety Law indicated that China has taken a big step of reform.however, the complete set system lags behind, food safety legal supervision system is not sophisticated, the foundation of food safety risk monitoring and evaluation system is thin, the food safety standards are non-uniform, and so on, which are all our attempt in the future. It is the author's useful researches on food safety legal supervision that improving the food recall system, establishing special supervision system of individual workshops, setting up food safety public interest litigation and liability insurance system.
