Research On The Legal System Of China’s Food Safety Regulation

Food safety problem is the people’s livelihood, not only thegovernment’s ruling ability, but also related to the vital interests of thepeople. While the food safety accidents happened frequently, make thegovernment suffered a heavy blow at the same time, also has brought theeconomic loss, but also do harm to people’s health and life. The people inthe right of life and health can’t be guaranteed under the suspicion ofgovernment ruling ability and credibility and improve the food safetyregulatory system is beneficial to the people’s livelihood event related.This paper mainly in the food safety supervision legal system, putsforward the existing problems in the system, combined with the actualsituation, to give suggestions.This paper is divided into six parts: the first part is the question,research background and significance of the problem is given, and somerelated theories at home and abroad, to pave the way for the followingparts; the second part is to determine the related concepts of food safetysupervision in this paper, is mainly the definition of food, food safety andfood safety regulation three a concept. In the end the concept, put forwardthe theoretical basis of food safety regulation-"market failure" and"government failure", completes the concept and theoretical support forthe following parts. The third part is the present situation of food safetysupervision in China legal system. This article discusses the status of China’s food safety supervision legal system and supervision systemstatus, and gives the legal system of food safety supervision in China atthe present stage in question, mainly is the legal system is not perfect,imperfect regulatory system, food safety supervision system is not perfectand the third party supervision system is not perfect. The fourth part is theforeign legal system of food safety supervision status and experience. Themain analysis of the United States and the European Union two foodsafety supervision system of more perfect state, through the analysis ofthe two national legal system and supervision system, some perfect legalsystem of food safety supervision for reference, put forward to perfectbelow China’s legal system of food safety supervision. The fifth part isthe perfection of the legal system of food safety supervision in China part.First, build and perfect the legal system of food safety supervision andregulation pattern from a macro point of view, the main is to establish andperfect the law system of principles, and then build centralizedsupervision mode and Food Safety Commission. second is theconstruction of food safety supervision legal system and other regulatorybodies and perfect；The sixth part is a conclusion. In the foodsafety supervision system proposed by the "Many departments ofsupervision " to "The centralized and unified supervision ", but under theexisting system, reform needs restructuring big, make basic advice, inorder to solve multiple regulatory problems, the relocation of food safetycommittee, unified and coordinated various departments. This paper putsforward suggestions only in theory, even can not be exhaustive, other notrelated to the problems left to continue to explore.
