Since the establishment of market economy system, the labor union organization in private enterprise has been gradually moving toward formal, and its development is very rapid. In present, the fundamental role of labor union that representatives and safeguards the laborers' legal interest has been more reflected. And it has been recognized by law and society. However, due to the special development process of China's labor union, labor union in a very long period of time acts as the role of "Party work department" "The third executive section"in the stage of society. There are still a big gap between the role of union in China and the role in Marxist union theory; the development requirement of socialism; the basic function of labor union in western developed countries and the requirement of its own development. In practice, problem of the labor union 's role has not fully resolved, even it has a larger conflict with the legally recognized role. The basic function of labor union in private enterprises is fuzzy, and unions did not play the role of safeguarding the interests of enterprise employees. The factors of lack of independence, attached to the party or government organs and private enterprises, and being neglected result in the difficulty in maintenance of rights, confuse in responsibility, poor independence and role ambiguity. Thus it has further intensified the contradiction between employees and employer, which causes potential problems for social stability. That is unfavorably for the overall goal of building stable labor relation and establishing a harmonious society. So solving the problems of labor union in private enterprise is more conducive to social stability.Therefore, in this article, the author at first introduces the labor union and labor union theories, and then describes the current status of union in private enterprises. After that, it compares the Chinese labor union with Occident's union. From the contrast, it has analyzed in detail the problems of labor union in our country and the reasons. Finally, it makes use of the contrast of the different union system between Chinese and Occident to draw the favorable factors to reform Chinese union system.
