The Problems And Countermeasures Of China's Community Correction

Embodying humanitarian ideas, Community Correction is the fruit of human's exploration of achieving maximum effectiveness with the lowest cost. It has punishment, education reform, service, investigation and recovery festures. It has been half a century since the first proposal and construction of community corrections in 1960s. In China, the idea of community correction can be traced to the ancient legend "Own Prison," but most scholars believe that the concept of Community Correction comes from abroad. According to China's official definition,Community Corrections refers to comply with the conditions placed on offenders within the community, by the special social groups in the relevant state organs and civil society organizations and volunteers with the assistance of the decision, determination or decision identifiedwithin the period of psychological and behavioral correction of their criminal habits and to promote its successful return to society the implementation of activities of non-custodial sentence. Since the official execution of Community Correction in 2003, it plays an important role in lowering costs, preventing and reducing crime, and helping offenders return to society. More importantly, it has a tremendous significance in maintaining social stability and building a harmonious socialist society.The community correction is regulated into law since February 25th,2011 when National People's Congress Standing Committee voted and passed theCriminal Law Amendment (Ⅷ), ending a long-standing embarrassing situation of having no legal basis for Community Correction, thus is of epoch-making significance.All along,community correction is worked by our grassroots level judicial administrative departments,but law does not explicitly its function in the process of community correction, making the administration of justice in carrying out grass-roots community correction process encountered a lot of embarrassment. Due to the harsh sentences of Ideas, our people do not agree on the work of Community Corrections, which hindered the promotion of community correction. At present, the lack of talent on psychological correction of Community Correction's relatives leads to community correction object of psychotherapy is still not put into practice, some of the psychological problems of Community Corrections has not been really resolved, and this detrimental to their return society. Community Corrections are generally grass-roots judicial staff to manage and correct, there is no specific community corrections staff, judicial staff as a small grass-roots level, and commitment to the work of the complex, which makes a lot of community corrections staffobject management is inadequate. I conduct a survey on Community Corrections of Huai Ning Country, found that the concept of felony, poor laws and lack of professionals are the resistance of Huaining County Community Corrections.
