Analysis On Community Correction In Our Country And System Improvement

In March,2012the Supreme People’s court, the Supreme People’s Procuratorate, theMinistry of Public Security and the Ministry of Justice jointly promulgated the Measures forthe Implementation of Community Correction (hereinafter referred to as the "Measures"),which was formally implemented since March1,2012. The promulgation of the Measuresmarks of the comprehensive and formal establishment of community correction system as animportant system change in penalty execution and social management field in our country.According to the Measures, since March2012, except the criminals sentenced to deprivationof political rights, the criminals sentenced to surveillance, probation, parole and temporaryexecution outside prison shall be corrected by community correction organizations forcorrection. At present, the community correction system has been fully implemented aroundone and a half years. The author finds through participation in community correction thatalthough our community correction work has achieved certain results, such as free from orescape from management was significantly reduced and the recidivism rate of the criminalsunder the community correction decreases significantly, there is still a long distance from theultimate goal of educating and reforming criminals of community correction. Therefore, theauthor intends to combine years’ practice in community correction, comprehensively reviewsthe typical problems in the current community correction, and proposes the correspondingimprovement scheme to solve the problems.This thesis consists of the following five parts.Part One overviews the community correction system in our country. This partintroduces the nature, theoretical basis and purposes of the community correction system.Part Three introduces and comments the foreign community correction system, mainlythe characteristics thereof.Part Three introduces the development process of community correction in China. Theyear of2012is the dividing line of community correction in China, before which is the pilotstage and after which is the formal implementation stage in the whole country.Part Four reviews the problems in China’s community correction work and is the focus ofthe thesis. Based on the long line of work practice, the author comprehensively reviews thefive outstanding problems since the implementation of community correction, including the vacancy of special legislation, the deviation from the purposes of correction, theincompleteness of organization system for community correction, the failure to implementinvestigation and evaluation of community correction and the predicament of procuratorialsupervision.Part Five proposes the improvement program. As the priority among priorities of thethesis, this part mainly directs the problems detected in Part Four and proposes the feasibleimprovement scheme from the operational level, including the introduction of speciallegislation for community correction, constructing the systematic community correctionorganization, promoting the mechanism for quality assessment, optimizing the means ofprocuratorial supervision and enhancing the cognition of the whole society on communitycorrection.
