Discuss On The People's Mediation Of Rural

As a part of Chinese socialism legal system, people's mediation rooted itself in the five-thousand-year culture. It has been an important and effective method to cope with social conflicts. It has been a very powerful tool to keep society stable especially in rural area. It has been playing a crucial role in reality. It is labeled the oriental-experience and the first perimeter for social stability because of what was mentioned. How to make social function of people's mediation system more effective is now a valuable research project because people know better about the limitation of the principle of ruled by law and multiple conflict solution system. As I have always been interested in social problems and people's mediation, I picked a typical developing city in Pearl river delta district as the research object in how the people's mediation in rural area works. This research is based on the fact that the reform and opening policy keeps going deeper and economy keeps developing. This paper's research method is indifferent investigation. Three steps are involved in this paper. They are theoretical support empirical research and systematic analysis. First based on the empirical research I had done I clarified the meaning of this paper and introduced the review from home and abroad that I collected. Then I defined the research object and introduced the research method. Second I made the background of why I chose this case clear summarized the characteristic of the conflicts in rural area in the transformation of the social. Then I analyzed the situation of the people's mediation system. Third I revealed the problems that rural people's mediation system is facing now and analyzed the reasons. Last but not least I offered some suggestions to improve the people's mediation system according to the reasons I mentioned. There are three suggestions which are completing the people's mediation committee and training the mediators, setting the mediation standards and perfect the people's mediation agreement building the financial safe net enhancing the supervision and enforcing the bond between people's mediation system and legal system and other alternative dispute solution systems. The author hopes that the suggestions which are based on the problems and reasons can be effective when it comes to the perfection of people's mediation system and make people's mediation keep pace with the reform and opening policy and keep the people's mediation works effectively all the time and protect people's rights and keep the rural area stable and make it more useful in building the socialism new rural area and harmonious society.
