Our Non-profit Organization Set Up Legal Obstacles Solutions

Since the 21st century, the non-profit organization develop rapidly. It is a major organizational innovation and institutional innovation outside the market system and the state system. It can make a positive effect which the market and the government are unable to attend, especially in charity field. After reform and opening-up, China started legal process and related non-profit organization legislation also gradually set up. But many problems exist in the development process, mainly displays in:the missing of Organic law,type partition is not reasonable,regulating messy, but the most important problem is the restrictions in the establishment of the Non-profit organization. The problems mainly reflect in:the obstacles caused by Mandatory registration,the obstacles caused by strict permission socialist,the obstacles caused by high thresholds registration,the obstacles caused by defects of tissue types. This paper tries to eliminate the barriers in the non-profit organization establishment progress on the basis analysis of the barriers on non-profit organizations. Specific measures are admit unregistered societies,cancel the permission of establishment,eliminate quantitative restrictions,reduce the threshold of registered,encourage competition,relax to the use of funds establish reasonably non-profit organization types, to promote the further development of non-profit organizations.
