Rural Social Pension Insurance Legislation To Build

With the modernization process and changes in social structure, the traditional mode of family pension has been challenged. At present, urban pension insurance system relatively perfect in our country, can be a variety of state-owned enterprises to participate in pension matters. But the rural elderly in the face of the reality of rapid social transformation, and can not rely on far outside working family members. Therefore, the rural society endowment insurance gradually socialization, and become a prominent issue. At present, our country launched a new type of rural social endowment insurance pilot job in many places, but the problem of the relevant legislation does not improve is prominent. The Social Insurance Law of the People's Republic of China has been passed on October 28,2010. The law provides the principle for the rural social endowment insurance system, but its weak practical operability cause the attention of people. In contrast, many foreign countries, particularly in some developed countries have been gradually established their own respective national conditions matching rural endowment insurance law system, and passed legislation to establish guarantee rural elderly life. This paper gives an overview of exploration in legislation of rural social pension insurance, and analyses the problems from many perspective, like the transition of economic, social, cultural, legal, etc. In order to establish perfect system in rural society endowment insurance, it is important to learn the useful experience from other countries. In this way, we can ensure that the rural social endowment insurance system, and achieve the purpose of promoting rural social stability.The paper is divided into six parts. The first part is introduction, after an overview of the comprehensive existing literature, briefly introduces the purpose of research questions raised, and the method of the research. The second part summarizes the existing legislation of the rural society endowment insurance in our country. This part defines the concept between the social endowment insurance and rural society endowment insurance, and analyses the origins and idea from legislative aspect. The third part summarizes the exploration and change of legislation in the rural social endowment insurance of our country, and discusses the reasons after analysis the current problems. The fourth part sums up the suggestions to our country, after introducing legislation in foreign through the method of comparative analysis. This part compares the legal system of rural social endowment among Germany, the United States, Japan, India and Chile. The fifth part explores establishing and perfecting the legal system of rural social endowment insurance in our country, and puts forward concrete suggestions. The last part is conclusion.
