Housing price covers a wide field. Among them, It has not only the defective system, but has the market development degree problems. It has not only the authenticity of the social demand factors, but has the developers false hype factors. Both the investors excessive speculations and the estate business of hoarding behavior and so on. Housing price is the embodiment and reflection of the various problems and contradictions in the development of social economy. Exists in the field of real estate commercial bribery phenomenon is bright example. For one thing, money for bribe is used to increase the buildings'cost, adding to the house price in the name of"PR expense","social activities'cost". The burden is shifted onto the people who want to buy a house, and finally they are going to"foot the bill". It destroys the market operation system. For another, a number of unlawful real estate developers form an alliance with local officials though bribery. They dominate and manipulate the real estate market and the price of commercial houses. They can make big profits and illegal incomes. Under the bribery, the profits obtained by developers and officials from housing market are the same. They will do everything possible to prevent and weaken the regulation and control of the market, and suppress price putted by central government. Policies that the government has been following are weakened step by step and even ineffective. Meanwhile, It will seriously damage the Executive officials and social enterprises'honest image. If eliminating the cost of business bribe and fighting commercial bribery, house prices will go back to their worth. And then, the problem of the high house prices could be solved.Now, there is no unified legislature relating to business bribe in China, instead there are only some specific regulations. At the same time, there are no effective supports and policy to control the business bribe. The basic characteristics of commercial bribery is obvious. So commercial bribery tends to produce in real estate industry, and more focused on land transfers, engineering construction, the administrative examination and approval, property transactions, etc. In view of its dependence on all areas of different conditions, specific questions need to concrete analysis. Thoroughly analyzed all levels of the reasons which produce in business bribe in real estate. The bribe in engineering construction and AEA with land remising, of which problems has been revealed. Using the successful experience on punishment business bribe under the legislation system of abroad as reference, in view of business bribe, it will try to set up a long-term mixed mechanism which combine prevention and punishment: from perfect legislation to fair system, from macroscopic control of the government to enterprise management, from supervising to self-discipline. This problem should be our the meaning of studied it.
