Chinese real estate market develops very quickly. The academic research academic on macro-control over the real estate market is active, but more currently in economic circles. The thought of policy constitutors and executives are also economic. The reason probably is that the macro-control is an economic special field. But it has brought about the problem that the macro-control measures deviate from the legal request. Sum up experience in past, it has very strong necessity to analyze the macro-control over real estate market in a legal way. It's very important to bring the macro-control measures into play.The priority of the thesis isn't the rationality, but the legitimacy of the macro-control measures over real estate market. It concentrates on analyzing the basic theory and legal Countermeasures of the macro-control over real estate market. If the rational and effective macro-control measures over real estate market are short of the legal guarantee, it is surely shortsighted. Devoting more legal elements to the macro-control over real estate market, we will solve the problems for long and more impartially. The article is not confined to comment on law, but also attempts to get deeper enlightenment and thinking, and then hopes to unscramble the truth of the random of macro-control and provides new legal sense train of thought.The thesis is composed of the introduction and three major Chapters. The introduction aims at bring the questions, and then analyses the necessity and significance of the thesis. Chapter 1 will do a brief carding to significant macro-control measures over the real estate market recent years firstly, and then study on the fundamental theory problems of the macro-control over real estate market, as the starting point and basis of the next content. Chapter 2 will concentrate on analyzing several macro-control measures over real estate market and relating legal problems, striving to embody the fundamental theory in analysis. Chapter 3 attempts to sum up the previous problems in rules and regulations. The conclusion of the thesis is that macro-control measures over real estate market should insist on fairness is supreme and give consideration to efficiency, should attach more importance to the coordination mechanism between the central government and local government, the orientation of government's function. To manage the real estate market as one important component of Chinese socialist market economy's norm as ruled by law, reinforce nomocracy and neaten order, probably being really is reliable and ultimate way out.
