The property declaration system of civil servant refers to that the official declare and register property in fixed period to the specific state organs, which audit and publish the result. This system is also known as "the sunlight bill", and adopted by more than 90 countries as an effective weapon of preventing and punishing corruption in the world. At present, although in China this system already have extensive public base and high prestige of public opinion, it's hard to carry out widely, except in few places. From the point of view of law, the property declaration system of civil servant is still in the tentative stage.Going through the property-based reporting system of civil service status, you will find that there are all kinds of drawbacks. Firstly, I think their legal hierarchy problem should be solved from the legislative level, "Property Declaration Act of the Civil Service" in which a clear declaration of the subject, the contents of the declaration, the time and the associated legal liabilities and penalties should be formulated by the NPC. Secondly, I think that it's very important to improve the relevant laws and regulations and various relevant measures to ensure the property declaration system of civil service smoothly and successfully. Thirdly, I think that it's also very important to carry out Property Declaration act of Civil Service steadily and gradually and the goal of system of the property declaration can be realized by making use of the buffer.In this circumstance, the author wants to serve the following purposes through this article:First, this article clear the basic connotation of property declaration system of civil servant, annotates legal principle theory behind the system, argue for the justness and deserves from psychology and economic angle; Second, introduce information about this system in overseas, and for discarding and reference; Third, analyze the development of this system in our country, point out the flaw in practice, further raise the proposal to perfect it. This article utilizes the comparison analytic method, the survey procedure, and the interdisciplinary methodology writing method, aims to enhance article's persuasive power by analyzing in multiple perspectives and demonstrating thoroughly.This article mainly divides into four parts:The first part introduces the elementary theory of the property declaration system of civil servant systematically; The second part makes comparison of institutions in different countries which carry out the sunlight bill; The third part introduces the present situation of this system in our country, and points out the deficiency; The fourth part, is the key part of article, proposes suggestion and further constructs property declaration system in China.
