The Study On Employment Assistance To Vulnerable Groups In Our Country

In the midst of social accelerating transformation period, China has the increasing number of vulnerable groups, which have already become tremendous groups. Their employment is not only the priority of our economic issue, but also a unique social issue closely linked to the national economy and the people's livelihood, as well as the social stability. Restricted by their own physical condition, their know-how and level of skill, they can hardly get jobs instead, they are in need of the state intervention and the employment assistance. To improve the legal system of employment assistance for the vulnerable groups is of great significance in solving the problem of their employment, as well as the construction of harmonious socialist society. It is not only in favor of their right to live and labor, but is also beneficial for achieving social justice, maintaining social stability, promoting economy and enhancing international competition.The masterstroke in this thesis is to improve the legal system of employment assistance for the vulnerable groups. It analyzes the current situation and the reasons of the vulnerable groups'employment and the deficiency of the existing legal system. On the basis of the legislation experience abroad, the thesis proposes a precise suggestion for the legal system of employment assistance for vulnerable groups in China.This thesis is composed of four parts. The first part is about the fundamental principle of employment assistance for the vulnerable groups. First of all, the conception of vulnerable groups is analyzed in a multi-discipline point of view and the conception as well as scope of the vulnerable groups'employment is defined. Secondly, it defines the employment assistance and principle based on practical activity. The theoretical support for the employment assistance is the market failure which needs the state intervention, and especially embodies the empirical fairness of employment right for the vulnerable groups. Lastly, it analyzes the significance of employment assistance in China.The second part is the empirical analysis of the employment assistance. Firstly, this part analyzes the current situation of vulnerable groups'employment and the reasons of it. Then it introduces the existing legal system of employment assistance and analyzes the deficiency of it.The third part is about the international experience for the vulnerable groups' employment assistance. This part mainly introduces the legislation of employment assistance in three developed countries—the Netherlands, the United States of America and Japan. Through the analysis, it summarizes the experience of employment assistance for the vulnerable groups, with which to improve the legal system of it in our country.The last part is the core of this thesis, concerning about the tactics to enhance our employment legal system for vulnerable groups. There are two aspects: one is conceiving of the legal system establishment in China for the vulnerable groups, and the other is a proposal for the precise improvement of this employment assistance.
