| The Commission of Discipline Inspection of the CPC (CDIC), according to the constitution and regulations of the CPC, use the power to perform its most basic functions of punishment by doing the "quasi-judicial" activities to protect the normal operation of party discipline. Therefore, CDIC in fact is exercising one kind of "quasi-judicial" function. The efficiency of the "quasi-judicial" function is directly related to the effectiveness of anti-corruption of CDIC and inner-party supervision. In the process of establishing and improving socialist market economy, inner-party supervision is necessary for CPC to maintain the advanced nature. This article focuses on the scientific definition of "quasi-judicial" function and how to regulate the function and improve its effective.In the beginning, the article combs the present researches about CDIC in academic circle. In the first chapter, it defines the main function of CDIC according to the relevant constitution and regulations of CPC and its practical work. Comparing with the judicial function of the courts, procuratorates, public security organs and judicial organs, it draws a conclusion that the main function of CDIC has a certain judicial character. The second chapter is the key point. Firstly, elaborate the legitimacy basis of "quasi-judicial" function from the angle of inner-party supervision and the relationship between CPC and PRC. Secondly, viewing the function as a phenomenon of the party's discipline inspection, looking through the construction of inner-party supervision institution system and the development of CDIC as well as other anti-corruption organs, the article discuses the historical basis of "quasi-judicial" function. Thirdly, combining with the relevant data, it elaborates the effective of the function. In the third chapter, after analyzing the current domestic and international situation and the development trend, it summarizes the urgent problems and difficulties, and put forward the proposal to improve and strengthen the "quasi-judicial" functions.In conclusion, "quasi-judicial" function of Commission of Discipline Inspection of the CPC is different from the judicial functions of the state judicial authorities. In the anti-corruption mechanism against corruption of called "the CPC committees unified leadership, party-government together management, CDIC organization and coordination, relative departments responsibility, the people support and participation" the CDIC perform its "quasi-judicial" function scientifically and effectively, which is the inevitable requirement of improving coordination mechanism against corruption. Strengthening and improving the "quasi-judicial" function is the one way that must be taken to promote conduct and ethical governance of the CPC and fight against corruption. |
