Study On The Anti-corruption System Construction Under The Perspective Of Party Discipline And State Laws

Corruption is the enemy of our party, our country and the people, upholding integrity and combating corruption related to the survival of the party and the country. The party and the State has always attached great importance to fighting corruption and upholding integrity, especially after the reform and opening, the State has taken various measures to combat corruption, but corruption has not been effectively curbed, on the contrary,intensified corruption tour trend. The current anti-corruption situation remains severe.From 2012, party and national constantly strengthening anti-corruption of efforts,from party of mass line education activities to practice line "Three strict and Three Steadies", from "eight items provides" of proposed to "against four wind" of implementation, from Central sent visits group to continuity of "playing Tiger took flies" action, China from discipline and law two a level strengthening has anti-corruption of efforts.This paper,according to the background of China’s anti-corruption situation, briefly describes the relevant provisions and classification of party discipline and state laws about anti corruption and clean government, Uses theory to explain the concepts related to anti-corruption, and discusses from three levels, China’s traditional culture, Marxism and Western theories. It Focuses on analyzing two anti corruption lines,party discipline and the law of country vertically. It briefly summarizes the pros and cons of party discipline and state laws in practice and review and especially analyzes the different role played by party discipline and state laws.It summarizes and evaluates the history and effects of the two anti corruption level,party discipline and laws of country, and comes up with our anti-corruption construction trend and existing problems of system and practice. It mentions and summarizes "party discipline is the first defense line of corruption in our country, State law is The last line of defense against corruption.It points out the four main issues in China’s current anti-corruption system: lacking of specialized anti-corruption techniques,repetitive function of the anti-corruption agencies, poor mechanism construction and problems of system of party discipline and state laws. Finally, it proposes anti-corruption measures as follows. First, strengthen the construction of anti-corruption system from the State laws and improve the law on the "white space" of corruption.Second,strengthen the construction of anti-corruption system from the level of discipline ofthe party, strengthen the mechanism, normative, and the effects of education of the discipline system.Anti-corruption system construction from a single system to the system of institutional innovation, is the only way of addressing complexity and systemic anti-corruption work. Of course, the problem of the poor as a complex structure system,anti-corruption party discipline is not able to solve the problem, system of innovation,improve the mechanism, implementation of the system, modernization of culture, creating an excellent environment for also needs simultaneously. However, speaking from the roots,anti-corruption work must rely on the improvement and innovation of party discipline and state laws.
