Administrative Law Enforcement From The Perspective Of Performance Evaluation

The administrative law enforcement faces many problems,such as violence law enforcement, fishing type law enforcement, discount type law enforcement, etc illegal enforcement phenomenon. Meanwhile, the law enforcement effect is not good. Academic circle concerns the administrative law enforcement issues from multiple angles, but only from the administrative law enforcement itself to view and solve these problems; it is difficult to overcome the limitations of administrative discipline and root-curing. There is a new method to analysis the administrative law enforcement problem. This method re-examines the administrative law enforcement from a focus on the law effects and social effect of administrative enforcement. Public satisfaction oriented to the administrative law enforcement placed under the perspective of performance evaluation is analyzed. The preface part of this paper describes the background and significance of the topic, academic research situation, and research methods and innovative points. The paper is divided into three parts.The first part, the current situation of administrative law enforcement is analyzed in China. The administrative law enforcement effects are analyzed——illegal enforcement common and law enforcement social effect weak. There is the insufficiency and analysis of the administrative law enforcement problems in Academic circle.The second part, they introduce evaluation system and expound the concept and characteristics of performance evaluation system, and the simulative effect of the administrative law enforcement research. The administrative law enforcement is re-examined as a visual angle of the performance evaluation. The defects of the current administrative enforcement evaluation system, the value orientation of administrative law enforcement in the performance evaluation system and the enlightenment of which performance evaluation system analyzes the administrative law enforcement problems are analyzed. The last part, the administrative law enforcement is reconstructed in a guide of performance evaluation. The insufficient of performance evaluation practice is analyzed in China through the comparison of China and the United States government performance evaluation practice. Then rebuild our administrative law enforcement evaluation system, push the legalization of the administrative enforcement performance evaluation, construct the administrative law enforcement performance evaluation model and realize the unity of the administrative law enforcement legal effect and social effect.
