On The Construction Of Charity Legislation In China

Today,With the continuous development of our national economy and people's changing social attitudes, there are more and more enterprises and individuals involved in charity, for the social justice and stability to contribute their strength.The charity to develop very fast in the majority of the active participation of the people,and achieve remarkable results in the field of disaster relief, help poor and disabled,and so on.However,charity legislation which providing protection and relief-related is far behind the reality of the need to.Although both in official and civil appeal to charity legislation Strongly,State Council and National People's Congress Standing Committee also make a plan for charity legislation,but so far, "Charity Law " has not yet appeared.And other laws and regulations can not provide strong support and protection for charity, because they have a variety of defects and vulnerabilities.so,it is very necessary and urgent to build a sound charity legal system by legislation.In this paper, I try to construct China's charity legislation through analyze the legal issues of philanthropy. First, This paper analyzes the charitable status of legislation,then pointed out the problems of the legal charity system. Namely, the lack of uniform complete comprehensive charity the basic law, preferential tax incentive system is not perfected etc. This paper also analyze some of the main provisions of other national charity legislation and learn advanced experience.
