The Problem Of Administrative Punishment In City Management And Solving Measures

Our country carries out relative concentration of administrative punishment system in city management.Since the system has being carried out,it achieves significant effect in enhancing the level of city management. But in the process of running, it causes a lot of social contradictions. Up to now,many problems of law and system are not fundamentally solved.This paper analyzes from the field of city management to start the basic theory of administrative punishment. Through reviewing the practice and development of city management and law enforcement work in our country, and the application of "Digital City Management" system and new changes that government institutional reform brings about, it analyzes the current main problems that exist in system. And also through studying different experience in city management of foreign countries and regions, it proposes measures to improve city management in China's relatively centralized administrative punishment system,hoping to provide some theoretical reference for city management and law enforcement's taking rules of law, standardization and entering scientific way. The main innovations are the following: first, it conducts a comprehensive study of the impact on digital city management technology in recent years and government reform on city management law enforcement, and analyzes city management of the overall development trend of administrative punishment. Second, it abandons the national uniform legislation ideas, emphasizing the reality, and regulating the work of law enforcement on city management within the provincial area using local laws and regulations. Third is to improve city management and law enforcement personnel staff selection system, and establish stricter standards, higher-level management personnel recruitment, raise the entrance of exams system, improve the professional level of law enforcement personnel, and fundamentally improve the level of city management and law enforcement. The paper is divided into five parts. The first part is an overview on the theory of administrative punishment, mainly introducing the background of relative concentration of administrative punishment system, its power source, the system features and general principles. The second part is the practice and development of city management and law enforcement work in our country. It has reviewed the developing process and achievements of city management and law enforcement, analyzed "digital city management" technology and new changes that government reform has brought and summarized the city development trend of administrative punishment. The third part is the main problems of administrative punishment. It summarizes and analyzes four issues: be lack of enough legal support and law enforcement system is not straightened out. The type of relative concentration of administrative punishment is not scientific, and law enforcement officers are still not high qualified in law. The fourth part is the basic experience of administrative punishment in other countries and regions. It gives a summary and drawing experience in city management of the United Kingdom, the United States, Germany, Japan and Hong Kong. The fifth part is to improve city management measures of administrative punishment, which is the focus of the paper. To solve the problems, it proposes legislative support at the provincial level, scientific definition of the scope of the relative concentration of administrative punishment, the establishment of top-down city management law enforcement network, and it strengthens the assessment and management to improve the quality of law enforcement officers. It establishes mechanisms for city management external coordination of law enforcement.
