The Legal Limit Of Freedom Speech In The Internet

Freedom of speech is one of the most basic of the constitutional rights. Along with the Internet technology development, especially the speech problem that it brings, has become that governments have to face and solve problems. Freedom of speech in cyberspace does not have substantive change, but the new features of network speech do give the traditional law limits of the free speech to some new challenge, also make the traditional free speech problem become more acute and prominent. This paper focuses on the network of freedom of speech, it discusses the legal boundary and it has five parts:The first part introduces the network freedom of speech meaning. In this paper on the basis of free speech meaning, combining the characteristics of network, this paper discusses the network freedom of speech connotation, characteristics and value. The Internet freedom of speech as traditional free speech has the boundary, but has its own characteristics.The second part elaborates on China's legal boundary of network free speech and the regulation of the existing problems. Although in order to regulate Internet freedom of speech behavior, avoiding to bring our real life adverse influence, the country has issued a corresponding laws and regulations, but the fast development, the network has made us some flat-footed, and brings the theory and practice with a lot of problems.The third part introduces foreign law on the Internet freedom of speech and legal boundary of its regulatory and briefly analyses. I wish some help with our country making suitable network free speech law.The fourth part determines the factors on the basis of China's online free speech to be considered legal boundary, including both historical and international and Internet technology factors, and believe network freedom of speech that should follow the principle of legal boundary with rights and must resolve conflict, mainly having public rights and proprietary. The fifth part to perfect China's Internet freedom of speech, puts forward to some suggestions from the legislation of investigation of lawmaking, holds the environment by legislation idea, and establishes the legislative technique aspects of implementing mechanism discussed briefly in the paper.
