Study On Ecotourism Promotion Legislation

At present, ecotourism has become the fastest growing branch and the trend of tourism. The rapid development of ecotourism has injected new blood into China's economic development. Besides, it has triggered a series of environmental and social problem. Therefore, establishing a sound legal system of ecotourism is of great significance to the healthy development of ecotourism in China.Ecotourism is a kind of tourism that based on ecological principles and guided by the idea of sustainable development. It takes natural ecological environment and related cultural sites as location. Thus, the tourists can experience, understand and appreciate the nature and culture and as well get the environmental education. Also, this kind of tourism seeks for the harmonious co-existence of human and nature, and therefore helps to achieve the sustainable use of tourism resources and the sustainable development of tourism. Ecotourism legislation is no longer a law to manage ecotourism industry purely, as a kind of modern environment legislation, ecotourism legislation is to ensure and promote ecotourism development. Promotion legislation is a new type of legislation that adheres to the idea of new legislation and meets the requirement of the modern legislative model. It has been used in ecotourism in the Western developed countries which have achieved some results. In order to realize the environmental justice in tourism realm, the sustainable development of tourism and the consummation of tourism legality in China, it needs to accelerate the process of ecotourism promotion legislation.There are two aspects of work to do when doing ecotourism promotion legislation in China. First, select a legislative model. At present, China has already met the requirements to develop the basic law of ecotourism promotion and matching ecotourism laws. Based on the specific national conditions in China, the legislation of ecotourism should be guided by the Constitution and takes the model of making both the basic law of ecotourism promotion and promoted matching laws or regulations. Second, make clear contents of the legislation. Ecotourism involves three subjects, therefore, the ecotourism promotion legislation should specify the rights and obligations of each related subjects. Based on all of these, it will be capable to construe institutions that promote ecotourism, including the establishment and improvement of environment education system, the establishment of ecotourism certification system, the establishment of environmental liability insurance system and the consummation of public participation system.
