The discussion on the citizen's political rights has been one of the most important topics in the field of the legal theory research in recent years. Arendt's theory of the unique insight into the contemporary concept of civil and political rights provides one of the rich resources for thinking. Arendt on their political rights outlook analysis began in the Jewish situation of the totalitarian movement. Any ethnic group or nation, if lack of political rights consciousness, ignore their political rights, may become another Jewish nation into the victims of totalitarian movement in the specific historical conditions. Humanistic theory is the concept of civil and political rights of Arendt's theories. In addition to the ability by nature, people have the political ability. The potential ability make it possible to achieve the political life. The citizens' political character comes from diversity. Action theory is the most original part in the political thought of Arendt's and the core concept of the theory of civil and political rights. The reason for the existence of the political is freedom whose realm of experience is action. Only when citizens have the concept of human action, may be realized the political rights.From the regression and beyond the classical republicanism, Arendt conceived the public domain in thought from the fragments in the glorious history. Law open up and sustain a public domain, establish a democracy, equality and freedom of the public domain, so the public can truly become equal participation in public activities through the ideal platform for discourse. The division of the public sphere and private sphere is a fundamental condition of modern life, a healthy public domain is an important symbol of modern society. According to Arendt's view, the perfect life is a highlight of political life and citizen theory is the core part of her political theory. She clearly pointed out that citizenship is essential for the real part of public life. Political activities not only enhance public welfare, but also have more profound meaning:presenting a personality and communicating with each other. Through "Presentation" and "communication", citizens can get their own independent views on the basis of understanding public affairs, defend their civil and political rights, rational communicate with each other while defending their civil and political rights, thus promote the healthy operation of nation and society.Arendt firmly believed that politics was an irreplaceable human experience, only in the structures of equal participation and with a Multicultural Perspective can be displayed. The shortcoming of representative democracy is the rise and medium of political parties, the expansion of bureaucracy, the disillusioned of the citizen politics participation idea. Because representative democracy can not ensure the exercise of civilian political rights and provide adequate space of political participation, Arendt turned to search for more ideal political system. Participatory democracy originated form achieving human values in the public sphere. Deliberation system is the modern systems which may only possible realize Arendt's political principles. Culture and strengthen citizens' political participation of virtue is the preconditions of real political life. Arendt's theory of civil and political rights bring people to enlightenment and direction of citizen's political responsibility, appeals for public spirit, eulogizes of civic virtue, nowadays, which have realistic significance for the mature citizen society construction in China.
