In virtue of the publical character of the public life,there are more public advangtage and interest on themselve,their portrait and speech and action arose comprehesive attention and dense interest of the public,the public have intensive interest for the public life,differ about the non-public life,so no matter what the public life want or not,the law are in order to public interest or to cater to the right of public knowledge,we should restrict necessarily ofthe right of pensonality,for example, the right of portraiture.because of this,the right of portraiture have become to the cheif aim to use disesteemly such as spooting,uglifying,montaging.in our life,more and more invading incident about the right of public poretraiture.but the right of public poretraiture only restrict to use reasonable in order to public interest and benefit,but not to mean that their right are deprived completely and cannot claim their right about whatever somebody in any way.The right of portraiture of the public life should give way some individual advantage to media publics and make some sacrifice in order to satisfy the need of common interest of social being,but it should be protected as the people's right when it suffer illegal infringement.as a result of the publicity to a certain extent, the public life often don't knowledge what his right of portraiture was been employed insultingly under information asymmetry,the right to know of the public life get no guarantee, give rise to the problem of protect rights and adduce evidence.This essay try to discuss that right of portraiture of the public life to legal protection should adopt special constitutive requirements to infringement starting from special burden of production and criterion of liability,in order to get better protection than before.
