Network Public Opinion Expression And The Independence Of The Judiciary Relationship Studies

Network public opinion expression is a new social phenomenon, and it is developed with the progress of the internet. Compared with the traditional public opinion expression, there are so many differences between network opinion expression and traditional public opinion expression, such as lack of effective supervision, operating mechanism is different from the traditional public opinion expression, network public opinion expression is more time-sensitive; highly arbitrary; easy to quickly form a joint force; more wider range etc, and it will make a great impact on judicial independence. This paper is divided into four parts, including the production of network public opinion expression, the impact of network public opinion expression on judicial independence, how to position reasonably the relationship of network public opinion expression and judicial independence and how to build system to coordinate network public opinion expression and judicial independence. The purpose of the paper is to reasonably explain the phenomenon of network public opinion expression influence judicial independence, and to build system to coordinate network public opinion expression and judicial independence, consequently improve our long-term intervention of network public opinion expression in judicial independence.The first chapter is divided into three sections. Section I is to define the definition of network public opinion expression from the new thing about network public opinion expression. Section II is to further describe the network public opinion expression by comparing the network public opinion expression with common opinion expression. Section III is to show the consequences of network public opinion expression on the whole society through analysis of both positive and negative network public opinion expression.The second chapter is divided into three sections. Section I is to explain the supervision and the negative influence of network public opinion expression to judicial independence from the pros and cons. Section II is through three actual cases to analyze how network public opinion expression mainly to influence judicial independence. Section III is mainly from two aspects of the causes and ways to deeply-seated analyze the phenomenon that network public opinion expression influence judicial independence.The third chapter is divided into two sections. Section I is to analyze the value of network public opinion expression and judicial independence, so as to find their conflicts. Section II is through the analysis of defects in two existing judicial model to get their perfect positioning mode that is a moderate closed and communication judicial model.The forth chapter is divided into seven sections. Each section contains a kind of system frame including establish press spokesman system, establish scientific unobstructed opinion communication and expression mechanism, perfecting the people's jury system, strengthen the network supervision mechanism, strictly regulate the judge admittance system, reference "expert consulting system" and "court friend", standard judgment reasoning system.
