Studies On Formal And Informal Regimes In Nuclear Non-proliferation System

As a kind of WMD, the emergence of the nuclear weapon which drastically threated the peace and security of the human society. The situation is more serious after North Korea nuclear test in 2009. In order to prevent the proliferation of nuclear, the nuclear non-proliferation regimes were built in international community. In this paper, I adopt normative analysis and illustration analysis to study the effectiveness, limitations and perfect mearsures of nuclear non-proliferation system of the formal and informal regimes.In effectiveness aspect: The core legal norms---the Nuclear Non-Proliferation Treaty (NPT) and the cornerstone of the nuclear non-proliferation regime---the International Atomic Energy Agency (IAEA) have significantly contributed to hold back the vertical and horizontal proliferation of the nuclear and promote the progress of the nuclear disarmament and maintain the peace and security of the international community since they were established. As the non-official organizations of informal regimes, Nuclear Suppliers Group (NSG) and Proliferation Security Initiative (PSI) which play an important role in obtaining the nuclear materials for non-nuclear states through controlling exports and prevent the groups and private persons to smuggle the nuclear materials. Two regimes learn from and complement each other. However, the defects of treaties and absence of executive mechanism in formal regime, the indefinable provisions and illegality in inform regime have result in failure to achieve the final goal of nuclear non-proliferation regime-completely forbidden nuclear test and complete disarmament. Therefore, in the last part of my paper, I put forward many perfect methods and solutions to overcome these limitations, including amend NPT, improve its supervision agency and establish assessment mechanism.The analysis of the effectiveness, limitations and perfect measures of two regimes, is not only contribute to understand the situation, analyze the reasons of the nuclear crisis, but also help take reasonable measures to settle nuclear crisis.
