Research On The Prevention And Control Of Cyber Crime

The development and application of computer network technology is a important progress in human history, The computer network technology has and will continue to bring immeasurable enormous contributions for people. But at the same time, the wide use of computer network technology brings the enormous negative impact to the world of network and social order and the national legal system——Computer crime begins flooding all over the world. How to deal with cyber crime becomes a big trouble. This paper has analyzed the concept, features, status and the reasons of cyber crime. On this basis, this paper try to give some proposals both of legislation and judicial for the prevention and control of computer crime.This paper is divided into three parts:The first part gives a overview of the cyber crime. In this section, the author investigates in detail on definition, characteristics and the composition of cyber crime. The cyber crime and computer crime is related to but not entirely a concept of coincidence. The network crime has its own characteristics, such as virtual sex, invisibility, transnationality, etc, all above are the cyber crime prevention study should not be ignored. The composition of cyber crime have been study in this section, which is the key to recognize cyber crime by law.The second part is about the status and causes of cyber crime. The cyber crime is not ravage only in the western developed countries, but also flood in our country, which causes tremendous losses all over the world. Besides, the reasons for the cyber crime are complex, it includes both network culture and network technology reasons, however, the most important reason is Legal vulnerability.The third part focuses on the prevention and control of cyber crime.
