Land is the most important wealth, is the fundamental resource for economic operation, however, is very limited. More and more "humble abode" era people focus on the land which is closely related with the surge of real estate investment and development boom. We should cherish and make use of each inch land, make its value chain of interests get maximum extending.The land allocation system is derived from the planned economy time when distribute state-owned land, it is different from the encashed land transfer system. At the beginning, it has made a significant contribution, however today, lots of contradictions with reality come out. After adjustment, some bad phenomenon such as the waste of land, invisible market, and corruption still exists. Should the land allocation system still be existed or be abolished? The thesis will elaborate.Now present study focused on concepts, characteristics, the scope and the current legal system review of allocation land right, etc. But the author summarizes the recent relevant laws, regulations and academic achievements of allocation land right marketization, brings forth new ideas, insists marketization is the basic way to eliminate the negative effect of land allocation system. Compared with America, Japan, Britain, Canada, Singapore's land ownership system, land utilization system, land expropriation system and related land administrative system, from the angle of law and economics, interprets allocation land right transfer, lease, mortgage, assess etc. marketization models and its advantages, disadvantages, and also evaluation models and how to improve legal system at operation level. In order to provide helps for the construction of harmonious society.
