Analysis The Path To Promote The Construction Of Sunshine Government

In recent years, with the ever changing of the economic globalization era and the deepening further of China's reform and opening up, the problems of the government reform and governance caused not only the attention and concern of the government and academic research, but also is entering the public view gradually. To jump out of the old management mode, and the traditional administrative way, then to build a "sunshine government" which government information and administrative power is open and transparent, and can guarantee basic civil rights, honesty, high efficiency and standard management. That is catering to the development trend of world's "sunshine administrative", strengthened survival and development ability in the increasingly fierce competition of the international society, but also in the process of promoting China's political system reform and governance effect adapting to economic and social development, which is one of the most important ways to reshape the government image and ascend credibility, or is the basic medicine to restrict and curb corruption, but is the only way to ultimately realize the transformation from the rule of man to the rule of law. Obviously, building "sunshine government" as a key link in the construction process of China's socialist rule of law, which has became the booster and the inevitable trend of government transition, democratic politics development and the progress of political civilization.In this paper, the new perspective of civil rights based on the transparent meaning of the sunshine government, and probes its warmth meaning. Based on the practice analysis of China's representative construction of local government building "sunshine government", thus found the existing problems and obstacles in the construction, and then look at the United States, Singapore, Hong Kong as example, to analyze the effective and different from other countries' experience which is in the aspect of the right protection to the public as the center, and with the actual conditions in China to make an objective inspiration, finally to give the beneficial exploring thoughts and suggestion for the path problem of promoting sunshine government walking forward. The contents of this paper consist of five chapters and divided into three major parts.The first part is the theory of "sunshine government" and the study of its building practice in China, above content mainly covered in the first chapter. Firstly, "sunshine government" as western exotic, it is a kind of analogy argument to the ideal government of public expectation, yet it has not a clear concept definition, after analyzing its construction cause, background, purpose and meaning found that the sunshine government is not only to open and transparent information for ensuring the right to know of public, but also want to protect citizens supervision, participation, expression and other fundamental rights realize fully, on this basis to reach scientific good governance target of the coordination between government and public opinion. Such a government to let the power use for citizens will make people experience the transparent, and at the same time feel warm, thus enhancing the trust and recognition to the government. To comb position and rich connotation of the sunshine government laid the theoretical foundation for other chapters of paper. Secondly, study the advance practice and effectiveness of some typical areas in the sunshine government construction. Taking Yunnan, Shanghai and Shenzhen as example summarized the effort exploring, active practice and initiative innovation method to speed up the construction pace. These precious experiences have its own respective characteristics, which provide ideas for the sunshine government's path.The second part, analyzed some phenomenon in its building process to find the existing problems and obstacles, this part to be addressed in the second chapter. Excessive reliance on administrative agencies made the subject single of promoting construction. The poor channel of public suggestion led to public opinion distortion, after the e-government was praised for promoting government affairs public and process reform, appeared the formal orientation and disadvantages of the drawbacks with system, citizen consciousness, government workers' conception of rule of law, which are the urgent issues must be tackled in the process of constructing sunshine government, but also the obstacles that researching the promoting path need to over come.The third part, starting from exploring the enlightenment of other countries' experience to make the useful thinking for the promoting path of sunshine government construction in China, which is including the third, fourth, and fifth chapter. Mainly on the other basic rights as the core besides how to protect the citizens right to know, and analyzed the successful experience of the United States, Singapore, and Hong Kong in the construction of transparency and caring government. Then proposed to promote the construction subject to diversify, to build platform of public opinion expression, to optimize e-government, to perfect the government itself, to establish and improve the related systems of protection of public supervision, participation and democratic rights. Such strong feasibility path may deep the sunshine government construction.This paper uses literature analysis, theory with practice, case analysis, historical research, comparative and other methods for the in-depth explanation and argument of thesis topic and related issues, in which the empirical research of case to enhance the paper's pertinence, readability and persuasiveness. It is mainly reflected in analyzing the advance construction practice, summarized achievements and found the problem, and from the angle of history culture and traditional thinking to analyze the obstacle constituting the civil consciousness deficiency and government and civil servants' conception of rule of law being lack of. By the objective and scientific comparison to summarize the experience of countries and regions doing better in the civil rights protection. And combining with the national conditions to reference and discard, which provided a realistic basis for the path of promoting sunshine government construction.In this paper, based on the results of previous studies, break the inherent thinking way of strengthening government information to public. The topics were with new angle to expand research perspective. Through analyzed the goal that the sunshine government may achieve finally to rethink its proper meaning, to reposition it and to enrich its connotation. The Empirical studies based on the local government construction to find existing problems and obstacles, but not adhered to localization analysis rigidly, for making the reference to the new path. And put forward the important points innovatively that let its construction subject to diversification development, also put forward some explorative thinking with strong feasibility. Designed from the practice analysis, useful experience, practical summary to find imperfect solutions system and other existing problems, then found suitable conditions and more forward-looking approach ideas for promoting continuously of the sunshine government construction.
