On Government Procurement In The Duty Crime Prevention

The development process of China's government procurement system has experienced from small to large, from the first pilot to full implementation of the ten years, the scale of government procurement is becoming larger and larger, the procurement procedures are increasingly standardized, and the development speed is accelerating. But from this stage, the development of China's government procurement system is not mature, there are still many problems in the concrete procurement process, and especially the crimes committed of government procurement are obvious. Realizations of the characteristics of crimes committed during the Government procurement are: strong concealment, significant commerciality, experts are more involved. Causes of such crimes are varied, and the performance concentrated as follows: the purchase legal system is not perfect, decentralized procurement abuses is more, authority's power is excessive concentration, the oversight mechanisms is lack, the expert judges wariness is not strong, legal consciousness is weak, and so on. Such crime is dangerous, so must be prevented. Combine the actual of our country's procurement system, and based on the advanced experience of foreign countries, on the basis of the reasons of such crimes committed to find specific ways to solve problems, and give the following targeted prevention strategies: in terms of legislation, improve the government procurement laws and regulations, improve the prevention of corruption legislation and improve the provisions of Crimes in the Criminal Code. Out of the legislation, implement the combination of the government procurement and bribery file inquiry system, establish and improve the supervision oversight mechanism of government procurement, fill the Government Procurement Experts'Resource Library, and to strengthen the Government's own procurement team building, etc.
