Establishment Of Mechanisms For Crime Prevention Duties. Village Grassroots Cadres

This paper is the investigation about the duty crime prevention of the basic cadres in jing gang shan. It analyses the feature, the cause and the effect about this topic. Through comparing and researching the network position defence (set by the people'procuratorate in jing gang shan), we seek perfect methods to improve the duty crime prevention of the basic cadres, and adcance the harmony ,the development and the progress of the rural society.In the introduction, there are time, region, object and scope of this investigation. It briefly sums up the investigation's design and content and ensures the subjects of the duty crime in the basic cadres.The content of this investigation mainly includes types, features, causations and analysis of the duty crime.The features of the duty crime in the basic cadres in jing gan shan can be listed as follow: first of all, most of the subjects are hamlets or village heads. In the eight cases of twelve village cadres (investigated by the people's procuratorate in jing gang shan), there are ten persons who are hamlets or village heads. Second, the duty crime has the feature of group corruptions. Third, the crimes hold long time, happen frequently and amount from a small beginning to a mighty. The cases from 2008 to 2010 proof the total amount becomes more and more. Forth, crime areas mainly concentrated in the land compensation fees or the village collective capital. For example, in eight cases investigated by the people's procuratorate in jing gang shan. The are five cases involving land units compensation and two cases involving the rural construction fund, which account for the majority. Fifth, it is harmful to the society and it brings instabilities to the harmonious rural construction.The reason of these kinds of crimes is various. Some is a leak of the financial management. Some is a faultiness of employments about cadres. Also, maybe it is the shortcoming of the applicable law.In this paper, we will discuss the fundamental elements of the duty crime prevention in the basic cadres, including the component, the influence and the difficulty.In the forth part, this paper describes the three kinds and the methods of the duty crime prevention and the specific methods. This paper also analyses the current problems of the people's procuratorate to the village cadres. In the judicial practice, the people's procuratorate usually takes the way of the procuratorial suggestions. In the part of the way to prevent , this paper analyzes the advantages and disadvantages of the procuratorial suggestions and gives some own views about how to use procurational suggestions.To this, the style is more and more clear. From the consummation of the network prevention to the enhancement of the financial system, from the usement of special funds to the correct management of suggestions, this paper sums up a new method to improve the duty crime prevention of village cadres.The topic of this paper is very valuable.
