Study Of Legal Issues Of The Bilateral Trade Agreement Between Mongolia And China

ABSTRACT:The bilateral trade agreement is a written agreement to adjust their mutual economic and trade relations between the two countries. In recent years, bilateral trade agreements have mushroomed developed, showing different characteristics and trends. Currently, all countries want through national and international policies to encourage expansion and diversification of foreign trade, develop trade in goods and service, and promote trade liberalization. Many countries removed bilateral trade barriers to facilitate cross-border trade flows between the Parties, and to relax or abolish restrictions on their actions. Since economic liberalization in the early90s, in order to develop and encourage trade between Mongolia and China signed bilateral trade agreement between them. However, there is no any foreign and domestic research on Mongolian bilateral trade agreement with foreign countries. The thesis provides an overview and analysis legal issues of the bilateral trade agreement between Mongolia and China, explore ways to strengthen bilateral trade agreement between the two countries.About research value, this is the first study of selected topics discussed. This thesis mainly use combination of inductive and the interpretation analysis, combination of empirical and normative analysis method, to compare the characteristics of Mongolia and China's economic cooperation and trade relations, to analyze the existing problems in the bilateral trade agreements in Mongolia and China, in the last to propose suggestion to strengthen and improve the bilateral trade agreement between Mongolia and China. Also, the two countries will sign bilateral free trade agreements were discussed.The first part briefly summarizes the overview and new development of bilateral trade agreement. Mainly mention the definition and characteristics of the bilateral trade agreement, the content structure of the agreement, and its new development.The second part introduce bilateral trade relations between Mongolia and China. Particularly, talk about foreign trade strategy of Mongolia, the recent economic situation and foreign trade of Mongolia, the Mongolia-China bilateral trade and economic development and characteristics.The third part regarding overview of "The Trade Agreement between Mongolia and China". Review beginning of bilateral treaties between Mongolia and China, and view background of bilateral trade agreement between Mongolia and China, and discus; the main content of the agreement.The fourth part mainly analyzing and evaluating the bilateral trade agreemen between Mongolia and China. The author considers that the bilateral trade agreemen between two countries has number of shortcomings to be improved. For example, in the existing agreement has not definition and scope of application provisions. Besides, then are questions on trade treatment and trade cooperation provision.The fifth part mainly discussing countermeasures for improvement of the bilatera trade agreement between Mongolia and China, and proposing measure for revise the agreement. For example, the present agreement need to increase trade treatment and provide important provisions of the trade agreement, improve the bilateral trade agreement implementation mechanisms, and approve required foreign trade law.Along with two countries continuous expanding cooperation, legal environment o mutual cooperation constantly improve, also I believe that Mongolia and China's futurd economic and trade cooperation will be a healthy and steadily move forward.
