The Legal Protection Of Consumer Right On The Internet Transactions

With the booming development of Internet, network transaction has enters people's life. However, due to the constraints of customer awareness, network environment and legal policy, many problems still exist. For example,lack of security protection, substandard product and no compensation for damage, which always make customers'legal right be violated.In recent years, in order to protect the development of electronic commerce, the State Council and relevant ministers have issued a series of relevant laws and regulations. But these regulations did not make a clear rule about the protection of the right of network customers. Among them, very few rules refer to the protection of the customers'right during the network transaction. At present, there are several laws and regulations that can be used as a basis. For example, "Civil Code", "Contract Law", "Customer Protection law", "Anti-Unfair Competitive Law", "Product Quality Law", "Advertising Law", "Computer Information Network and the Internet Interim Provisions", "Computer Information Network and Internet Security Protection and Management". Therefore, in order to enhance the protection of online customers, promote the perfection of the laws and regulations about protecting online customers'right, improve the level of online consumption and achieve the rise of network economy, it is very important to protect the right of network customers in the form of laws and regulations.In order to establish a sound protection system for the network customers and protect the right of network customers, China should consider the advanced practice and mature experience of other countries, improve the relevant legal system and establish the law system to establish network customers' right as soon as possible. And also new uniform laws should be developed to standard the network transaction behaviors. In addition, international cooperation should be strengthened to promote the development of network transaction. Focusing on the new network transaction, the article describes the development situation of China network transaction, analyzes the specificity of network transaction and emphasizes the importance of protecting the right of network transaction. The article analyzes the problems of network transaction, learns the legislative experience of other organizations and countries and then proposes the suggestions about perfecting the law system to protect network customers' right.
