The Protection Of The Right To Privacy In We Media Environment

With the arrival of the era of "we media",both the expression room for commoners and the huge economic benefits for network service providers come true. The prosperity of "we media" on one hand promotes China's democratization and the development of the Internet, on the other hand brings the unprecedented challenges to the privacy protection. When people are immersed in the benefits of "we media", it also provides extra opportunities for acts of privacy volation. After confronting frequent acts of privacy violation, people began to concern privacy protection in environment of "we media". By studying privacy protection in environment of "we media" with the perspective to balance privacy and the other rights, this paper is to discuss how we can take privacy into account while keeping the other interests remaining protected, then to serve the theoretical and practical works.In addition to introduction and conclusion, the paper is composed of four chapters. Chapter 1 describe the concept of "we media", and give the definition of privacy within environment of "we media" by starting from the definition of traditional concept of privacy. Afterward, the chapter compares these two definitions, and summarizes the new features of the privacy within environment of "we media". Chapter 2 illustrates the infringements upon privacy within environment of "we media" in three aspects. Firstly, the features of the infringements upon privacy within environment of "we media", secondly, subject of infringements, and thirdly, infringements patterns. Chapter 3 analyzes the current status of privacy protection within environment of "we media" at the levels of legislation and self-discipline, and points out the existing deficiencies of the protections at legislation and self-discipline levels. Chapter 4 gives recommendations to improve privacy protection within environment of "we media". The protection derives from the perspective to balance the right to privacy and the other rights, bases on foreign experiences. The mode of protection establishes within environment of "we media" as "legislation based, self-discipline supplemented."
