"Property Law" In The Context Of Land Acquisition In Changsha

Along with the acceleration of China's industrialization and urbanization process and the increasing rhythm of non-agricultural of farmland, a great deal of rural land is expropriated, thus the number of landless peasants has increased year by year. However, because of the prevalence of re-acquisition of light around the resettlement situation, caused by land requisition of farmers to worry about can not be effectively addressed, lead to increasingly sharp contradictions with the government. Therefore, proper resettlement of landless peasants, solve their livelihood development issues, has great theoretical and realistic significance for implementing the scientific development concept, the construction of socialist harmonious society and development of new socialist countryside.This article on the base of domestic and foreign related research, elaborated the land requisition implication and the elementary theory comprehensively. Through retrospective China's land requisition system, analysis of its features and the effectiveness of system changes, and Comparative analysis with foreign land requisition system, revealed the system of difference. Furthermore, Analysis of Several useful Exploration about the current domestic model on the land requisition compensation, in order to improve the mode of land requisition compensation and Policy-making of Hunan Province.In this paper, on the basis of a comprehensive analysis of the current situation and problems about Hunan land requisition compensation and resettlement mode, combine foreign useful exploration, based on the concept of People-oriented and Sustainable livelihoods, and follow the optimization principles, to optimal design the existing models, proposed land for protection type, land investment type, stay and employment of combined, and conduct an empirical analysis. Finally, come up with optimization strategies and recommendations of land requisition compensation and resettlement mode.
