Legal Problem Of Energy Conservation In Shanxi Province

In modern society, the environmental pollution gets from bad to worse. The main reason for this phenomenon is the increase in energy consumption and the expansion of pollutants'emissions. Gradually, the environmental protection has begun to be attached importance to globally, which has made the energy saving and emission reduction a very hot topic. Since coal resources are our pillar industry, for years, the environmental pollution has exerted a subtle influence on the development of Shanxi Province politically and economically, and the pollution has become a serious obstacle to accomplish the development indicators in Shanxi Province, China, or even the whole world. Thus, the energy saving and emission reduction in Shanxi has significant importance. The Shanxi.Province Environmental Protection "11th Five-Year Plan", which has been released from the Shanxi Environmental Protection Bureau, shows the specific mission requirements and emission reduction targets. And the actual performance has been very well with gigantic achievement in the areas of economy, society, technology, environment and culture. However, this does not cover up the problems we have been encountered. According to the energy saving and emission reduction tasks and goals for Shanxi Province, released by the National Development and Reform Commission, during the12th Five-Year "period, the energy consumptions per GDP should fell to16%, chemical oxygen demand emission should decrease by8%compared to2010, Sulfur dioxide emissions decrease and new increase in ammonia and nitrogen oxides should all decrease by10%compared to2010. To be more practical, Shanxi Province also adds fume and industrial dust as indicators for local control total. To complete the series of indicators in Shanxi Province, we will be faced with enormous challenges and pressures.In this paper, with the research of the legal issues in energy conservation and emission reduction, we are in the hope of providing legislation reference during the12th Five-Year "period in Shanxi.The full text is divided into three parts:introduction, body, and conclusion, of which body part contains the contents of:The first section describes the current situation facing the problem of energy saving in Shanxi Province, and illustrates the work performance in recent years. Great achievements and contributions are made for the country's energy saving during the11th Five-Year period, while the difficulties are not small. In the long run, these difficulties will still be faced with in our province.The second part starting from the basic concept of energy conservation, analyses the underlying principles and further uncovers the reason to implement energy saving and emission reduction. By comparing the legal issues in this field in Shanxi province with those nationally, we may recognize room to improve in terms of legislation, law enforcement, and system constructions.The third part is to learn from the system and experience on foreign energy saving laws, mainly in Germany, Japan, the United Kingdom. Besides, we analysis the effect of international conferences on energy saving. Combined with practical work in Shanxi, we may locate gaps to fill in related to legislation and law enforcementThe fourth part, which is the core in the paper, contains the recommendations of the legal system of energy saving in Shanxi Province. With all the complementary proposals, we are determined to better equip our legal system of energy saving with advanced legislation, law enforcement, and legal system, and to cope with practical issues during the execution.With the adoption of categorical analysis, comparative analysis, and social empirical analysis in this paper, energy saving status home and abroad has been analyzed, and existing problems have been spotted. In the end, recommendations to improve the legal system of energy saving in Shanxi Province have been put forward.
