Volunteer Organization Public Law Studies

Since1993the Central Committee of the Communist Youth League decided to establish association of Chinese youth volunteer, volunteering development is swift and violent. With the Wenchuan earthquake, Beijing Olympic Games and the Shanghai World Expo, the volunteer organization is not only helpful new era image of Lei Feng, the cultivation of citizen moral consciousness and promotion of citizen spiritual power, become more assist government to provide public service for society administrative assistant, to fill the space between state and society separation. Correspondingly, to effectively manage and regulate the volunteer organizations for the orderly and healthy development and its social function, a lot of related research and study gradually entered the field of the law scholars. The practice of local legislation and the confusion of regulations also impelled scholars on how to manage the volunteer organization for further study.This paper is mainly divided into four parts:The first part is about the volunteer organization overview, through drawing lessons from the West and China's practice of volunteer organization definition experience, proposed constitutive description of volunteer organization, defines the concept, and in the second part of the volunteer organization theory is made comb.The second part is about the legal status of China's volunteer organization analysis, through the analysis of China's volunteer organizations and the development of legislation present situation, proposed the volunteer organizations for national legislation is the problem of existence and inadequacy, put forward to take law constraint solution.The third part is about the volunteer organization law regulation principle analysis, first to volunteer organization of public law regulation is the premise of the subject of administrative law qualification confirmation, and then on the law regulation and demonstrated the necessity of public law, and finally give an analysis of the regulation modes and legislative codes. The fourth part is that based on the public law regulation principle above, design a detailed legal regulation legal system, including volunteer organization of main structure and operation of the system, a volunteer organization incentive system and volunteer organization supervision system.
