Our country is higher education examination of superpower,higher education charged with the regulation of social distribution of benefits, to ensure social justice and promote social harmony in the task.On the one hand,government, as the higher education entrance examination of the organizers and managers, the adequacy of the implementation of its behavior is directly related to higher education entrance examination system of the perfect or not, also directly related to education, fair and just.On the other hand,governmental organizations,to recruitment and examination of many aspects such as registration, examination, admission, etc., are directly related to the administrative counterpart realization of the right candidates and universities,so need to regulation of government behavior,In this paper,from the perspective of administrative law in the entrance examination of higher education with fewer government behavior, but in reality, this area constantly exposed corruption in recruitment, examination fraud cases and other issues need to be resolved under study.Although the documents related to test all levels of government in higher education entrance examination makes provision for the duties,but the higher education entrance examination is a huge project, the government acts in the course of implementation that will be problems emerging,from the administrative point of urgent need to study this issue.This paper focuses on higher education entrance examination in the regulation of the government issue, need more thorough discussion.First of all,the higher education entrance examination of China's current situation to analysis,from the historical development of higher education in China start,the government introduced to the implementation of this act in the examination process and responsibilities of the basis and content,as higher education entrance examination and departments involved in many aspects, the need for the Government's role and content of a detailed description of,also need to act based on its implementation and the existing relationship between the sort of administrative law, and thus from the perspective of administrative law basis for government action.Second,focus on higher education entrance examination of the necessity of government action,explained from the perspective of administrative law of the theoretical basis of higher education entrance examination and functional analysis,etc..it help clear the current higher education entrance examination in the importance of government action,but also the administrative features and functions of analysis, for in the depth analysis of the problems of higher education entrance examinations to provide a theoretical basis.Third,this article appeared in the examination of higher education as a key to study the issue,try to analysis of government behavior problems and the exercise of reason,especially the analysis of legal norms is not complete, need to the introduction of National Education Examinations Act, the government provides the legal basis for administration according to law,combined with China's actual conditions, examination of current educational administration authority, with unclear responsibilities detailed analysis,a brief analysis of the single exam approach is to meet China's current demand,and the examination process as an administrative infringement of the rights of candidates relative to lack of sound research and analysis of legal remedies means.Finally,higher education entrance examination from the actual situation, the examination process for the exercise of government action to make recommendations that emerged,a clear focus on the development of uniform national examination law,in the framework of administration by law, rational division that the central and local government and the rights and responsibilities of universities,proposed diversification of examinations.By Britain and America and other countries learn from the examination bodies, institutions and organizations to promote our examination of the gradual non-governmental,at the same time a clear focus on the examination process, the exercise of government behavior and integrity of the legal responsibility to protect the legitimate rights and interests of candidates to propose a solution of legal relief system,that improve higher education entrance examination system.Due to the current law experts from the administrative is that point of view of higher education entrance examination system of government actions in the theory of lack of sufficient,entrance examination for higher education needs of government action during the inter-disciplinary, multi-angle to be studied,in view of this,the purpose of this study is from the perspective of administrative law and resolution in the entrance examination for higher education to regulate the exercise of government action to protect the entrance examination of the fairness and justice, and the education enrollment of reality has a positive meaning.
